Terms of Service

These terms govern your use of the Competas platform and services. By registering for an account, purchasing or using a token, or taking an assessment, you agree to these terms. Please read them carefully.
1. Who we are
The Competas service is provided by Competas Global Limited ("Competas", "we", "us"), a company registered in England and Wales (company number 09912563), registered office 1 Beauchamp Court, 10 Victors Way, Barnet, Hertfordshire, EN5 5TZ. You can contact us at contact@competas.com.
2. The service
Competas provides safety and technical competency assessment and passporting for the energy sector. The service includes competency and psychometric assessments, the profiles generated from them, and a competency passport recording the outcome.
Access to assessments is provided through tokens. A sponsor (which may be an organisation or an individual) purchases tokens and assigns them to candidates, or a candidate may sponsor themselves. A token entitles the named candidate to take the associated assessment.
3. Accounts and eligibility
You must provide accurate registration information and keep it up to date. You are responsible for keeping your login details confidential and for activity under your account. You must be old enough to enter into a contract in your country of residence.
You may be required to verify your identity, including by providing a photograph, and assessments may be proctored (recorded) to confirm identity and integrity. How we handle this data is set out in our Privacy Policy.
4. Payment
Tokens are purchased through our payment provider (Stripe) or, where agreed, by invoice. Prices are as stated at the time of purchase. Where payment is by invoice, tokens or access may be withheld until payment is received, and overdue invoices may be subject to interest and recovery costs as permitted by law.
5. Refunds
Tokens and assessment fees are refundable only at Competas's discretion. You do not have an automatic right to a refund, including where a candidate does not complete an assessment, or where an assessment outcome is not what a candidate or sponsor hoped for. Any refund granted is at our sole discretion and does not create an expectation of future refunds.
6. Assessments and outcomes
Competas assessments measure competency and produce a profile and passport reflecting that measurement. They are not a pass or fail examination, and Competas does not determine or certify whether any candidate has "passed", "failed", or is suitable or unsuitable for any role, task, or employment. The interpretation and use of an assessment outcome is a matter for the sponsor, employer, or other party relying on it, not for Competas.
If a candidate wishes to be assessed again, a new token and a new assessment are required. We do not offer re-sits of the same assessment.
We may void or withhold an assessment result where we reasonably believe there has been a breach of assessment integrity, including identity misrepresentation, collusion, or a proctoring violation. A voided result does not entitle you to a refund.
7. Passport validity
A competency passport is valid for three years from the date of issue, after which it should be treated as expired. A new assessment is required to obtain a current passport.
8. Acceptable use
You agree not to:
- share, resell, or transfer your account or a token except as the platform allows;
- attempt to gain unauthorised access to any part of the service or another user's data;
- copy, extract, scrape, reproduce, or attempt to reverse-engineer the assessment content, question bank, methodology, or any part of the platform;
- misrepresent your identity or another person's, or assist anyone in doing so;
- interfere with the security or proper operation of the service.
Breach of this section may result in suspension or termination of your account and voiding of any results, without refund.
9. Intellectual property
All intellectual property in the Competas platform, the assessments, the question bank, the assessment methodology, the competency and psychometric models, and all related content and materials, is owned by Competas Global Limited or its licensors, and is protected by law.
You are granted a limited, non-exclusive, non-transferable right to use the service for its intended purpose. Nothing in these terms transfers any ownership of, or right in, the Competas content or platform to you.
A candidate's own personal results and passport belong to that candidate to use and share as the platform allows, but this does not include any right in the underlying assessment content, questions, or methodology.
10. Availability
We aim to keep the service available and working, but we do not guarantee that it will be uninterrupted or error-free. We may suspend the service for maintenance, updates, or reasons outside our control. We may change or discontinue parts of the service.
11. Liability
Nothing in these terms limits or excludes our liability for anything that cannot lawfully be limited or excluded, including death or personal injury caused by our negligence, or fraud.
Subject to that:
- We are not liable for any indirect or consequential loss, or for loss of profit, business, goodwill, or data.
- We are not responsible for decisions any sponsor, employer, or third party makes on the basis of an assessment outcome, which they interpret and rely on at their own risk.
- Our total liability to you arising out of or in connection with the service and these terms is limited to the amount you paid to us for the token or assessment giving rise to the claim.
12. Termination
We may suspend or close your account if you breach these terms or if we are required to by law. You may stop using the service at any time. Termination does not entitle you to a refund except at our discretion, and the sections of these terms intended to survive termination (including intellectual property, liability, and integrity provisions) continue to apply.
13. Changes to these terms
We may update these terms from time to time. Where changes are material, we will make that clear. Continued use of the service after a change means you accept the updated terms.
14. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you have under the law of your country of residence.
